1Payment Obligations
The Student agrees to pay the full tuition fee for all enrolled courses as set out upon registration, and in accordance with the payment policies. A minimum of seventy percent (70%) of the total fee must be paid before the Student may access LMS materials, session recordings, or attend any live tuition session.
The remaining balance must be paid no later than the date specified in the payment schedule. Where a Student fails to settle the balance by the due date, the Firm reserves the right to suspend the Student's access to all tuition resources, including the LMS and live sessions, until full payment is received.
2LMS and Session Access
Upon confirmation of the minimum payment, the Student will be granted access to the Firm's Learning Management System (LMS), which provides recorded sessions, study materials, and past examination questions for enrolled courses.
Session links and timetables will be shared by the Student Services Officer before the commencement of each diet. Access to the LMS and sessions is personal to the Student and may not be shared, transferred, or used by any other person.
Any breach of this obligation will result in immediate termination of access without refund. The Firm does not guarantee uninterrupted access to the LMS and will make reasonable efforts to restore access promptly in the event of a technical outage.
3Attendance and Engagement
The Student is expected to attend all scheduled live sessions for enrolled courses. Attendance is tracked each session. Where a Student is unable to attend a session, they should notify the Student Services Officer in advance.
Recorded sessions will be available on the LMS within 24–48 hours to support catch-up learning. The Firm strongly encourages active participation, asking questions, completing assignments, and sitting mock examinations as these are key indicators of examination readiness.
Students with persistent absences (three or more consecutive sessions without notice) will be contacted by the Student Services Officer and may be referred to the Academic and Training Manager for support.
4Deferment of Tuition Fees
Tuition fees paid to Jhavilah Consult are committed to the specific diet for which a student is enrolled and are non-transferable to any subsequent diet under any circumstances. If a student is unable to continue with a diet after payment has been made, the following shall apply:
- A student who wishes to defer must submit a written request to the Firm no later than seven (7) days before the commencement date of the diet as communicated on our social media pages. Requests submitted after this deadline will not be considered, and any fees paid will be forfeited in full.
- Deferment is granted at the Firm's sole discretion.
- Where deferment is approved, the student shall be required to pay a GHS 100.00 administrative fee before the deferment is confirmed.
- The original fee paid shall not be credited or refunded, but carried forward; the student will be required to pay the applicable tuition fee for the new diet in full. Any excess would be required to be paid by the student before the commencement of tuition.
- Where the student fails to enroll in the immediate next diet tuition, they forfeit the fees paid in full.
- Fees shall not be transferred to another student or applied to a different course or qualification level under any circumstances.
5Withdrawal and Refund Policy
Pre-Commencement Withdrawal: Where a Student withdraws from the diet in writing before the first session has been held, a full refund of any fees paid will be processed within fourteen (14) days, less a GHS 100 administrative processing fee.
Post-Commencement Withdrawal: Once the diet has commenced (i.e., opening night session), fees paid are non-refundable. The Firm's obligations, tutor engagement, LMS setup, and resource allocation are fully committed at that point.
Medical or Compassionate Grounds: Where a Student is unable to continue due to a serious medical condition or compassionate circumstances, the Student may apply for a fee credit to be applied to a future diet. The firm's decision shall be final. Supporting documentation (e.g., a medical certificate) will be required.
Opportunity Fund Awards: Amounts awarded from the Jhavilah Opportunity Fund are non-refundable and non-transferable under all circumstances.
6Examination Registration
This Agreement covers tuition preparation only. It does not include examination registration fees payable directly to ICAG, ACCA, CITG, or any other professional body.
The Student is solely responsible for registering with the relevant professional body, paying examination fees, and meeting the body's eligibility requirements before sitting examinations. The Firm may assist students with examination registration guidance as a courtesy service, but this does not constitute an obligation or guarantee of examination entry.
7Student Conduct
The Student agrees to conduct themselves professionally and respectfully at all times in live sessions, on the LMS, and in all communications with the Firm's staff and tutors. The Student shall not engage in any of the following:
- Recording, distributing, or reproducing session recordings, study materials, or examination content without the prior written consent of the Firm
- Sharing LMS login credentials with any third party
- Harassing, threatening, or disrespecting tutors, staff, or fellow students
- Engaging in dishonest conduct, including plagiarism in assignments
8Intellectual Property
All study materials, recorded sessions, presentations, practice questions, and other content provided by the Firm are the intellectual property of Jhavilah Consult. The Student may use these materials for personal study purposes only.
The Student shall not reproduce, share, sell, or distribute any Firm content in whole or in part to any third party, whether for commercial purposes or otherwise. Breach of this clause may result in legal action.
9Data Protection and Privacy
By signing this Agreement, the Student consents to the Firm collecting, storing, and processing their personal data for tuition administration, communications, results tracking, and alumni management, in accordance with the Data Protection Act, 2012 (Act 843) of Ghana.
The Firm will not share the Student's personal data with any third party without the Student's consent, except where required by law or professional body regulations.
The Student has the right to request access to, correction of, or deletion of their personal data held by the Firm, subject to legal and administrative record-keeping obligations.
10Photography and Testimonials
The Firm may, from time to time, request the Student's consent to use their name, photograph, examination results, or testimonial for marketing and promotional purposes. Such consent shall be sought separately and will not be a condition of enrolment.
The Student may withdraw consent for promotional use at any time by notifying the Student Services Officer in writing.
11Pass Rate Targets and Examination Outcomes
The Firm commits to providing high-quality tuition delivered by qualified and experienced tutors, supported by comprehensive study materials and examination preparation resources.
However, the Firm does not guarantee that the Student will pass any examination. Examination success depends on individual effort, preparation, and engagement. The Student acknowledges this and agrees that examination failure shall not entitle them to a refund or any other remedy against the Firm.
12Feedback and Complaints
The Firm values student feedback and is committed to continuous improvement. The Student is encouraged to complete all feedback questionnaires issued by the Quality Assurance function at the end of each diet.
Where the Student has a complaint about tuition quality, tutor conduct, or the Firm's services, they should raise it in the first instance with the Student Services Officer. If unresolved within five (5) working days, the complaint may be escalated to the Academic and Training Manager, and then to the Managing Partner. All complaints will be treated with confidentiality and handled fairly and promptly.
13Jhavilah Opportunity Fund
Where the Student has been awarded support from the Jhavilah Opportunity Fund, the award is conditional on the Student maintaining satisfactory attendance (minimum 75% per diet) and demonstrating genuine commitment to their studies.
The Firm reserves the right to withdraw Fund support for subsequent diets where these conditions are not met.
14Amendments
Any amendment to this Agreement must be agreed in writing and signed by both Parties. The Firm reserves the right to update its general policies (including LMS terms, session timetables, and conduct standards) from time to time, and will notify students of material changes via the Student Services Officer.
15Governing Law
This Agreement shall be governed by and construed in accordance with the laws of Ghana. Any dispute arising from this Agreement shall first be referred to the Managing Partner for resolution.
